AN ORDINANCE AMENDING ORDINANCE NO. 76
TO REVISE CHAPTER III, ARTICLE 4, SECTION 3-404 TO
REQUIRE A SEWER BACKFLOW PREVENTION DEVICE
IN ALL NEW CONSTRUCTION,
AND TO ADD THE DEFINITION OF "READY TO PROCEED" TO
ARTICLE 2 OF CHAPTER IV
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE BROOKTRAILS TOWNSHIP COMMUNITY SERVICES DISTRICT AS FOLLOWS:
Section 1. Ordinance No. 76, known as the Utilities Code, is hereby revised as follows:
Section 3-404, under Chapter III, Article 4. BUILDING SEWERS, LATERAL SEWERS AND CONNECTIONS, of Ordinance No. 76 is revised to read as follows:
3-404. Sewer Too Low. In all buildings in which any building sewer is too low to permit gravity flow to the public sewer, sanitary sewage carried by such building sewer shall be lifted by artificial means and discharged to the public sewer at the expense of the owner.
Section 3-404(a) under Chapter III, Article 4. BUILDING SEWERS, LATERAL SEWERS AND CONNECTIONS, of Ordinance No. 76 is added as follows:
3-404(a). Sewer Backflow Prevention Device Required. In all buildings a sewer backflow prevention device shall be installed in the building sewer at the expense of the owner.
Section 4-201(e), under Chapter IV, Article 2. DEFINITIONS, is added as follows:
4-201 (e) Ready to Proceed shall mean those applicants who have received a water compliance order exemption granted by the State of California Department of Health Services.
Section 4-303, under Chapter IV, Article 3. ALLOCATION PROCEDURES - MORATORIUM, is revised to read as follows:
4-303. Allocation of Connections. As capacity to make connections becomes available, the available connections shall be allocated to applicants who are ready to proceed in the chronological order in which applications were received by the District. When a connection becomes available to an applicant, such applicant will be notified by written notice addressed to the address appearing on the application. The applicant shall have forty-five (45) days following the tendering of notice to notify the District in writing that the applicant intends to proceed, to produce a valid building permit for the structure to be served by the connection and to pay all connection fees and other charges imposed by this code or other regulation or law, applicable at the time of notification. If the applicant does not comply with all provisions evidencing readiness, the applicant shall be notified that the allocation is terminated. Thereupon, the next ready to proceed applicant in chronological order shall be notified and given the opportunity to proceed.
Section 2. Effective Date. This Ordinance shall become effective thirty (30) days after its adoption by the Board of Directors of the District. Within fifteen days after its adoption, the Board Secretary shall post copies of this Ordinance on the bulletin board in three places within the Township as follows: The Administrative Office, the Community Center, and the Golf Pro Shop.
