The Board of Directors of Brooktrails Township Community Services District
met in special session on June 20, 2000 at 7:00 p.m. in Brooktrails Community Center.

Roll call showed the following Directors present: Orth, Venturi, Monteleone, Estabrook, and Whitney. Also present were General Manager Williams, District Counsel Neary and District Architect, Bob Axt.

H. ACTION AGENDA

1. REVIEW OF EXISTING SITE DEVELOPMENT STANDARDS

General Manager Williams explained that the Site Development Standards were developed as a part of the Specific Plan, and District Architect Axt uses them to review new development in the District. Additional standards were developed in response to the number of manufactured homes being installed, to make them more compatible with the terrain. These were submitted to the County Board of Supervisors to be incorporated into the Specific Plan, and will be placed on an upcoming agenda.

District Architect Axt reviewed the additional standards which were devised to make developers understand that manufactured homes are subject to the same standards as "stick built" homes. Because of problems that have arisen in the past, he felt that a second inspection should be done prior to the pouring of the foundation, to assure that the placement of the home complies with the plans as approved.

Bob Houtz, of Harrah Place, suggested a committee be established to monitor construction in progress. Concerns were raised about liability issues and private property rights. In response, District Counsel Neary clarified the role of the Architectural Review Commission and the appeals process.

Director Venturi suggested that the County Code Enforcement Officer be notified right away of suspected violations, as he has responded quickly in the past and could suspend the building permit.

Director Orth pointed out that the County has to inspect the site prior to the concrete foundation being poured, and he felt that they should also check for compliance to the approved plans at that time.

Other concerns raised included the lack of encroachment permits when developing the approach to the lot, homes being built on unstable soil, and height limitations.

Director Monteleone asked that the construction service provisions be added to the Site Development Standards packet. She presented a draft notice to be distributed to local realtors informing them that the standards are in effect and are available at the District office, and that the District has hazard abatement program. She also suggested an ad be placed each Friday in the Willits News real estate section. She stressed the need for lot owners to be made aware that they cannot cut trees or grade their property without District approval.

President Whitney suggested a future agenda item be scheduled to discuss adding a requirement of a second site review prior to the foundation being poured, and for Board review of the flyer and newspaper ad proposed by Director Monteleone.

A break was called to change the tape.

2. REVIEW PROCEDURES FOR FOLLOW-UP TO CITIZEN COMPLAINTS

President Whitney began the discussion by reviewing the avenues currently available to residents who wish to file a complaint, including the BPOA complaint form, the County Planning and Building complaint form, the newly drafted District "Request for Action" form developed by Kris Wagner, and writing a letter to the appropriate agency.

General Manager Williams felt that good response was received from most agencies, however, the Department of Transportation was the least responsive.

Maria Bates thought that the Department of Transportation should be held accountable if residents were unable to leave the District during a wild land fire, and suggested a letter be drafted urging them to respond.

General Manager Williams summarized the District's complaint policy, and spoke highly of the material developed by Ms. Wagner. Director Monteleone pointed out that the form also provides space for suggestions, as well as complaints.

Bob Houtz voiced concern about debris left in the gutters by contractors working on hazard abatements, and felt that the Board should add a section to the contractors agreement addressing it. Discussion ensued concerning the proper means of disposing of slash, and the need for the Fire Department to ensure that it is disposed of properly prior to signing off a lot.

Director Venturi suggested a future agenda item be scheduled to review the proposed "Request for Action" form.


I. SPECIAL REPORTS - GENERAL MANAGER

General Manager Williams reported on the meeting of the evacuation plan review committee.

President Whitney reported that the deadline for the 319(h) grant had been met to obtain funds for restoration of Willits Creek in the Summer Meadow and Lake Emily spillway areas.


J. PUBLIC COMMENTS

Mike Aplet voiced his opinion that residential rental properties should be treated as any other business, and be subject to the provisions of a use permit which could be revoked if zoning violations occur on the property.

Kurt Ackerman voiced concern about on-street parking and lack of sinage.

K. ADJOURNMENT

Director Orth moved to adjourn and President Whitney declared the meeting of June 20, 2000 closed at 9:30 p.m.
